Insurance companies know that a lot of time will be involved in a personal injury case because of the extensive discovery process that occurs. Discovery is used to determine all kinds of information regarding an incident such as injuries, details about the accident itself, any witnesses, and anything else that might be useful in establishing liability. When a case is settled outside of the court system, this discovery process takes longer because discovery is not part of the standard protocol that a typical personal injury lawsuit goes through.
